MANUFACTURER'S LIFETIME WARRANTY:

This product (Farasafe Enclosure) is offered to you (“Customer”) conditioned upon your acceptance without modification of the terms, conditions, and notices as follows:

Terms Of Use: Use of the product is solely the responsibility of Customer, and Customer assumes all risk associated with the purchase and/or use of this product. Safestate Defense Corp assumes no responsibility for any personal injury, death, or property damage associated with the use of this product. Customer assumes all responsibility for ensuring that all reasonable safety precautions are followed in connection with the use of the product. Customer’s use of the product must adhere to all local, state, and federal laws and ordinances.

Determining the nature of these laws and ordinances is the exclusive responsibility of Customer.

Limited Lifetime Warranty:

(1) Safestate Defense Corp offers a lifetime warranty, limited to the repair or replacement, at its sole option, of all Shielding Enclosure Components, excluding Consumable/Replaceable/Wearable parts (HD Compression Foam, EMI Gasket, Surface Coating, Hand Strap), found to be defective in materials or workmanship affecting the quality and function of the product when properly maintained in accordance with Safestate Defense Corp recommended procedures, including CERP (Continuous Enclosure Reliability Program), and under normal use and service. Repaired or replacement enclosure, and/or components covered under this warranty, will be provided on an exchange basis and will either be new or refurbished to be functionally equivalent to new. If Safestate Defense Corp is unable to repair or replace the product, it will refund the current value of the product at the time the warranty claim is made. This warranty does not cover any product damage resulting from misuse, abuse, or unauthorized service or modification, and does not apply to any product that has not been handled or packaged correctly, has been sold as second hand, or resold. The determination of coverage or applicability of this warranty is solely Safestate Defense Corp’s, and its only obligation will be the repair, replacement, or refund for defective products. This warranty shall extend only to the original purchaser with proof of purchase. Safestate Defense Corp reserves the right to change the terms of this End User Customer Warranty at any time without prior notice.

(2) THERE IS NO EXPRESS OR IMPLIED WARRANTY, REPRESENTATION OR CONDITION OF ANY KIND (INCLUDING, WITHOUT LIMITATION, WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR USE) EXCEPT FOR THE EXPRESS WARRANTY IN PARAGRAPH (1) ABOVE, OF THIS END USER CUSTOMER WARRANTY. Any other implied warranties, including without limitation the implied warranties of suitability and fitness for a particular purpose, shall be limited to the duration of this warranty, otherwise the repair or replacement as provided under this express warranty is the exclusive remedy of Customer, and is provided in lieu of all other warranties, express or implied. In the event applicable consumer law prohibits the disclaimer of an implied warranty, the above warranty shall not extend the time period of any such implied warranty. Some states do not allow limitations for consumers on how long an implied warranty lasts, so the above limitation may not apply to you. This End User Customer Warranty gives you specific legal rights, and you may have additional rights, which vary from state to state.

Misuse And Abuse, Unauthorized Service or Modification:

The product is intended exclusively for maintaining high shielding effectiveness within the Inner Shielded Tube, through manual operation of the Compression Hatch, and within the static and unstable environments associated with land vehicles, sea vessels, and aircraft. Defects or damage that result from the improper operation, storage, misuse or abuse, accident, or neglect of/to the product are excluded from coverage under warranty, including, but not limited to, physical damage (corrosion, dents, cracks, scratches, etc.) to the surface and/or interior of the product resulting from misuse, contact with corrosive water or chemical, abrasive materials, sand, dirt, rocks or the like, or subjecting the product to abnormal usage or conditions.

Use of the product with any components that are not manufactured by Safestate Defense Corp, and any defects or damage attributed to the use of third-party components or solvents in close contact with the product shall invalidate any warranty claim, regardless of the extent of damage. Excluding periodic replacement/installation of EMI Gasket by Customer, any defects or damages resulting from servicing, testing, adjustment, improper disassembly/installation of Inner Shielded Tube or Compression Hatch, improper maintenance, including without limitation, any modifications, alterations, additions, or changes in any way to the product that are performed by Customer or any person, other than those approved by Safestate Defense Corp, are excluded from coverage under warranty and shall invalidate any warranty claims.

Customer’s Duty to Notify Safestate Defense Corp:

Customer shall notify Safestate Defense Corp in writing of any warranty claim within thirty (30) days after the Customer first discovers an alleged defect. Written notice shall be sent via electronic mail (e-mail) to warranty@farasafe.com. Following Customer’s notification, Safestate Defense Corp reserves the right to inspect any and all defective products submitted under a warranty claim. Customer shall obtain written approval from Safestate Defense Corp before returning any products to Safestate Defense Corp for a warranty claim. Products returned for warranty claims must be shipped to the address assigned by Safestate Defense Corp at the time of the claim and at the Customer’s expense. Pending the outcome of Safestate Defense Corp’s investigation of the failed product, shipping charges to Customer may be reversed.

Safestate Defense Corp is not bound to provide financial restitution in cash for faulty products and reserves the right to repair or to replace a faulty product with a new product. Safestate Defense Corp reserves the right at its discretion to repair or replace only those products submitted for inspection.

Safestate Defense Corp is not liable to repair or replace any product thought to be defective that is not sent to Safestate Defense Corp for inspection.

Limitation of Damages:

SAFESTATE DEFENSE CORP SHALL NOT BE LIABLE TO CUSTOMER FOR ANY EXEMPLARY, PROXIMATE, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, WHETHER ARISING UNDER CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHER THEORY IN LAW OR EQUITY, INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF PRODUCTION, OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PRODUCT, TO THE FULL EXTENT THAT THESE DAMAGES MAY BE DISCLAIMED BY LAW.

SAFESTATE DEFENSE CORP’S MAXIMUM LIABILITY TO CUSTOMER SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT GIVING RISE TO THE CLAIM, DEMAND, OR CAUSE OF ACTION.

Safestate Defense Corp shall not be held responsible for voidance of any warranty, including any third-party warranty associated with products and equipment stored within enclosure for shielding purposes, due to, arising out of, or in connection with the use of this product. Customer assumes all possible risk, damages, and associated costs of the voidance of any third-party warranty arising from the use of this product. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

Limitation of Actions: Any action for any loss or damage with respect to the products or workmanship covered hereunder must be commenced by Customer within one (1) year after Customer’s cause of action has accrued.

Entire Agreement: This End User Customer Warranty document states the entire obligation of Safestate Defense Corp with respect to the products.

If any part of this End User Customer Warranty is determined to be void, illegal, or otherwise invalid or unenforceable, including, but not limited to the warranty disclaimers, liability disclaimers, and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this End User Customer Warranty shall remain in full force and effect. No employee or agent of Safestate Defense Corp or any other party is authorized to make any other warranty in addition to those made in this End User Customer Warranty.

Choice Of Law: This End User Customer Warranty is governed by the laws of the State of Florida, USA. You hereby consent to the exclusive jurisdiction and venue of courts of competent jurisdiction in all disputes arising out of or relating to this product. Use of this product is unauthorized in any jurisdiction that does not give effect to all provisions of this Disclaimer, including without limitation, this paragraph.

Modification Of Terms and Conditions: Safestate Defense Corp reserves the right to change the terms, conditions, and notices under which Safestate Defense Corp’s products are offered.
